You can argue all you want over what the law should be. As a lawyer, people pay me to tell them what the law is, not what they'd like it to be.
Many, many grave constitutional issues are never resolved by the courts. There were numerous attempts to get the courts to decide if the Vietnam War was constitutional, and the courts consistently refused to get involved. I am telling you that, in my professional opinion, the odds are overwhelming that the courts will not decide Obama's qualifications one way or the other. I may be wrong; Judge Carter has yet to release his decision on the motion to dismiss. But I have been right in my predictions on these threads since last Fall, and I will be surprised if I am wrong about this case.
