CA: Feinstein planning major delta legislation

Washington - -- California Sen. Dianne Feinstein, considered a pre-eminent broker in the state's water wars, said Wednesday she is planning one of the biggest pieces of legislation she's ever attempted, to address the water and environmental crisis in the Sacramento-San Joaquin River Delta.

Feinstein told The Chronicle of her plans after a fiery public hearing at the Interior Department in Washington, where Secretary Ken Salazar fended off angry charges from Central Valley congressmen that the Obama administration has failed to respond to the crisis that is devastating California's farm communities.

The legislation is still in the idea stage, but Feinstein has told her staff to scour other major water restoration projects, from the Great Lakes to the Everglades, to find a way to fix the delta, one of the world's largest natural estuaries.

"We are looking at putting together a major delta restoration act," Feinstein said. "There is enormous national significance of this delta estuary. It's 2,000 miles of levees, it goes up through Sacramento, and it is an enormous inland body of water that has not gotten the attention it needs. It is crumbling and in an earthquake could come down entirely."

'As fast as we can'

She also called for waiving the Endangered Species Act to speed water transfers from the delta to farmers. "Just get it done as fast as we can," she said.

...The legislation is still in the idea stage...

Those poor people will be dead and buried before there is a government "solution." Salazar and BO could fix this immediately, if they chose to, and end this man-made disaster.

She’s lying. She’s lying again. She’s diverting attention from her Delta fishy to an emphasis on condition of the Delta levees which weren’t the primary issue for cutting off the water to the San Joaqin Valley in the first place.

In so doing this she is saying she is going to use the condition of the levees as her support for what she is responsible for destroying instead of the Delta Smelt. Her acknowledgement of the Endangered Species Act appears as a secondary instead of the primary of reasons she used to cut off the Central Valley Farmers water.

IMO she did this not unusual move, for her in the first place to force the landowners off their land so her friends, associates could buy it all up at fire sale prices down the road, and then all of a sudden the little fishy would then be tossed under the bus.

Typical Feinstein manuever. She’s used it before for personal gain feeding her Husbands business ventures with sleight of hand legislation.

Typical Democrat Criminal Liar.

If you read the article basically delaying tactics calling for more studies and the like. I suppose provides enough cover for Feinstein and Zero to say they are “doing something”.

But what about the poor delta smelt? Oh, the inhumanity of this!

Feinstein is catering to the evil capitalist big-farmers and is killing the fish! Just to feed humans? Humans, the scum of the planet. Let them starve, Dianne. Long live the smelt!

Salazar and Feinstein are playing “good cop-bad cop”. One is calling for a committee and one is calling for a study.

The problem of water in California is 2-fold: #1, and by far the biggest problem, is that Los Angeles only gets enough rainfall to support 250K people. L.A. Dept. of Water and Power diverts enough water from all over the state to support 3 million people and no end in sight. Now they want to ration the water Nor Cal uses; #2, Under the previous governor, the law was changed so that now farmers have to pay for water, and compete against cities. They used to get as much as they needed from the Friant Dam on the San Joaquin River. Thousands of acres of the richest farmland in the world was turned over to developers in the Central Valley.

Just wait until the price of produce skyrockets due to none coming from the Central Valley. Once Mexico, etc., realize we HAVE to import our produce they will raise the prices. This way not only are the farmers of the Central Valley going broke but the people in the rest of the country will as well. When our country is completely on it’s knees the people will be glad for the Socialist’s handouts. That is the way you break a country and bring in your Marxist agenda.

The Great Gold Heist

On October 8, 1994 the biggest gold heist in history occurred, but this theft lacked the melodrama of a Jesse James holdup or the excitement of a Brink's truck robbery. Nary a word was reported by the media even though this thievery was committed in the light of day. The citizens that were being robbed tried to cry out for help but the lawmen wouldn't listen because unbeknownst to them they were helping the bandits gain their booty.

Too late DiFi. You diddled and dithered and now the jobs are gone and the crops are dead. Fruit and nut orchards need 5 to 20 years to replant, mature and produce crops. These farmers are as good as dead.

Who wants to bet the pieces of poop in CA will complain about fruit and vegatable prices.

Someday there will be a major back-lash against these so called environ-mental-ists and it will be ugly.

No, he is responding as planned. Wait until there is a man-made food shortage in order to take advantage of the crisis.

Great.. there goes any possibility of any water being released even in BIG rainfall years. The levees are ALREADY being fixed.. CA is paying for that already by way of a bond measure passed during Schwarzie’s first term (or have we all forgotten about those billions already?) for seismic upgrades to be done there. OOPs, guess I wasn’t supposed to mention that one.
Last thing we need is this IDIOT (Feinswine) getting herself and her Bay Area cronies involved in more of this mess.

She has been a continous liar and playing the west side all along just to pull the rug from under our feet. When you have two radical democratic senators you don't have much choice but to attempt to work with them. But the real issue is that within a few days the Untied States Interior Department will be in contempt of a Federal Court order for failing to provide drainage for Westlands or a settlement, which she was supposedly also attempting to negotiate. Now the federal judge will either place secretary Salazar in jail or fine the United States everyday for failing to meet its obligation under law..........

This reminds me of the DDT ban. First we were told that DDT made raptor birds eggshells too weak and that the shells would be crushed when the birds sat on them. Then we were told that DDT made the eggshells too hard and that the chicks couldn't break out. Then we were told it causes cancer in birds, then cancer in humans.

First we are told the water is cut off to protect the Delta Smelt. Then we are told it is to protect the Salmon industry. Now it is to protect the delta. They can't keep their lies straight.

If they are so worried about 'deltas' why don't they stop the promotion of corn based ethanol which is destroying the Mississippi River delta and creating a huge dead zone due to crop runoff into the Mississippi, caused by an increase of corn production because of ethanol mandates.

There are always two sides to an environmental story. We need to look at the environmental impacts resulting from the proposed change.

I remember reading about this in an article waaaaaaaaaaay back before Cranston died. That article was emphasis on Cranston, This one is emphasis on Feinstein. I don’t remember the author of the other article, but whether the same person or not, this makes the second time I’ve read about the Great Gold Heist, and wondering if the investigation ever did begin.

Apparently not.

IN FRESNO: FEDERAL COURT ORAL ARGUMENT IN PLF'S DELTA SMELT LITIGATIONOctober 2, 2009 – 1:30 p.m. PDT

WHERE: Fresno Federal Courthouse, 2500 Tulare Street; Courtroom 3, Hon. Oliver Wanger.

WHAT: Oral argument in Delta smelt litigation (San Luis & Delta-Mendota Water Authority v. Salazar; Case # 1:09-cv-407.)

This consolidated lawsuit challenges the Delta smelt "biological opinion" that has led to draconian pumping cutbacks into the main water system serving the Central Valley and Southern California. In this consolidated litigation, Pacific Legal Foundation attorneys represent three San Joaquin Valley farmers hard hit by the federally mandated water cutbacks.

See: http://community.pacificlegal.org/ Page.aspx?pid=902.PLF's causes of action are constitutional and statutory.

PLF argues that the federal government lacks constitutional authority (under the U.S. Constitution's Commerce Clause) to issue regulations on the Delta smelt, a fish found only in California and without commercial value. PLF also argues that federal regulators did not perform their legal duty to assess the economic impacts of the pumping cutbacks. Access PLF's briefs in the "case resources" column: http://community.pacificlegal.org/ Page.aspx?pid=900.

WHEN: Friday, October 2, 2009. Oral argument begins at 1:30 p.m. The first issue to be addressed will be PLF's constitutionally based cause of action.

WHO: PLF attorney Brandon Middleton will present oral argument on behalf of PLF's clients and constitutional cause of action. Other attorneys with other legal firms and organizations, representing other litigants, will argue additional causes of action thereafter. PLF director of litigation Jim Burlingwill also represent PLF's clients in the hearing.
Sincerely, Robin L. Rivett,
PresidentPacific Legal Foundation
