What ACORN does is despicable. Our recent very strong emphasis on following the Consitution during the Obamacare debates, however, has had me studying every word. There is something in there that says a bill of attainder is illegal.

Apparently, when the Constitution was being written, the British Parliament had a history of punishing people and organizations it didn’t like (legislation targeting a specific person or organization for the purpose of punishment is called a bill of attainder), and the Founding Fathers decided it was up to the courts or other agencies to be responsible for finding guilt and punishment, not Congress.

The ACORN legislation is clearly unconstitutional because it is a bill of attainder, and I think Conservatives should oppose it to show we stand for the principle of Constitutional law, always, not just when it leads to an end we support. We’re telling liberals to follow the Constitution. We should do no less than follow our own advice. THEY are hypocritical. WE should not be.

Absolutely. Bachmann and DeMint are distinguishing themselves in our lackluster Congress and Senate respectively.

About the bill of attainder thing. Before you jump on me for defending ACORN, what I mean is, there no doubt already are laws against what ACORN did and their funding must be pulled because of those. There is no need for congress to do this — it is up to the courts. That’s why BoTs are illegal. They effectively punish before there has been a trial, NOT, as has been mentioned in other threads on this subject, because BoTs themselves are indictments, trials, and verdicts. This whole thing is a distraction. ACORN must be smashed — using a BoT to do it is a mistake. My opinion.
