To be fair, Obama never said this provision didn't exist; he said that these provisions didn't constitute "death panels" - which, in a way, was true. Strictly looking at the language of these provisions, there's nothing
necessarily wrong with Medicare paying for counseling for people to draft living wills/etc - of course, it could lead to terrible results (people pressured into drafting living wills that they don't want), but the language of the provisions were not, by themselves, "death panels."
The Health Benefits Advisory Committee, on the other hand - now that's a "death panel"
