Subsection (c)(3) is what we refer to as the “jurisdictional means” part of the statute. These are interpreted by the courts so broadly as to be practically without teeth. We conservatives lost this battle decades ago. One can almost say without too much exaggeration that walking your dog across the street can be federalized as a crime if Congress wished to make it so. The document was created, and then there will be some activity, however tenuous it may be, connected to it involving electronic communications, the mails, interstate commerce or foreign commerce, which is enough for a federal crime.
