No one is guilty of treason anymore, because there’s no such thing as a crime against America, and we are not justified in having enemies.
Even George Bush could not find it in himself to demand that Congress declare war against al Qaeda and the 25 other Muslim groups on the State Dept.’s (legally mandated) Deignated Terrorist list.
While I agree with you about the mistake in not declaring war on al-Qaeda, treason is almost impossible to prove. That's why there has been less than a dozen people that have actually been convicted of Treason in more than 230 years. I think (although I could be mistaken), that there hasn't even been 50 prosecutions for treason in the history of the country.
I do believe that Adam Yahiye Gadahn, the young Californian man who's made several al-Qaeda video, has been indicted on the charge of treason. I would suspect, given his video testimony, that a conviction would be likely if he's ever apprehended.
