Actually, this may be a great time to challenge Wickard v. Filburn and its cumulative effect rationale. The conservative block of the SC may be willing to overrule Wickard and start narrowing the Commerce Clause.

Worse: see the Raich decision. Flatly stated that reducing demand in an illegal interstate market is actionable; opens the door to up-the-wazoo regulation of anything (including oh-dark-thirty dynamic raids), and I'd guess tobacco would be a prime candidate.
