Let me preface this by saying I know absolutely nothing about the fashion industry or fashion photography, but the pictures on TMZ look to me as if they're "outtakes" (I believe that's the term). I'm guessing that photographers literally take hundreds of photographs during a shoot and I bet they frequently catch things that "slip" out. To me, it looks like those are not intentionally nude. Certainly not Playboy style.

Plus, I wonder what kind of release a 20 year old girl would have signed. She probably wasn't smart enough to ask for editorial control, nor did she probably ask that the ones she didn't agree with or like would be destroyed - or even if she did ask, she probably didn't know how to verify if the indeed were destroyed or erased.

In my own wedding pictures, one of my wife's jiggly things decided to make a cameo appearance. The photog didn't even notice until he developed the pictures (long before digital photography). And yes, we got the negatives and he didn't charge for the prints :)
