Except the Supreme Court ruled against this almost 70 years ago.

And they ruled that black people aren't citizens over 150 years ago. Wickard v Filburn wasn't the first abominable miscarriage of justice produced by a deranged court, and it will unfortunately not be the last. The desire of tyrants to impose their will upon and steal the liberty and fruits of labor of others seems to recur generation after generation, and sometimes those tyrants wear black robes instead of white hoods.
