My bet is that Fitzgerald was hearing too many names too high up so he sprung the trap early before he had any evidence or need to put anyone higher on the witness stand. He didn't want to have to read either Obama or the Teleprompter-in-chief their rights or have them testify.
You need to trigger your trap early so you don't accidentally catch something stinkier than you want to handle.
