Actually, prior military. My uncertainty may come from the fact that I have not read every word of every story on this guy. I have not seen that he violated an order from a superior commissioned officer, just that he has questioned whether the Community-Organizer-in-Chief is qualified as Commander-in-Chief. I don't think he can be court-martialled for his questions without proof that Obama is qualified. If he has disobeyed orders, that's a whole different story, obviously.

The article said — “A U.S. soldier on active duty in Iraq has called President Obama an “impostor” in a statement in which he affirmed plans to join as plaintiff in a challenge to Obama’s eligibility to be commander in chief.”
Now, the military could tell him not to join in as a plaintiff, because questioning the Commander in Chief like that is against the military rules and regulations. And if he refuses to abandon it, then he can be prosecuted under the military law.
I don’t know if that has happened or not, but if not yet, then I suspect that won’t be too far behind...
