There in language in Porkulus allowing the state legislatures to override those pesky governors.. I believe they have 45 days, and it’s a simple majority

I've heard this, too.

Can anyone speak to the constitutionality of the Feds doing an end run around the state governors, while dictating the terms of how state legislatures should do this? This seems like an instant Supreme Court case.

I believe it would be the 10th Amendment.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
