An alien that has not surrendered to US jurisdiction is not under US jurisdiction.

So an illegal alien who commits murder in the US cannot be prosecuted or punished in the US ?!?!?!?

PS. Those of us who grew up in Florida know that Orange Peel Liquor is good stiff.... but it has no standing as an A-Peel-s Court!

False. Illegal aliens are subject to our laws just like anyone else. To say otherwise is silly.

What "under the jurisdiction" excludes is clear:

United States v. Wong Kim Ark, 169 U.S. 649 (1898)

"It thus clearly appears that, by the law of England for the last three centuries, beginning before the settlement of this country and continuing to the present day, aliens, while residing in the dominions possessed by the Crown of England, were within the allegiance, the obedience, the faith or loyalty, the protection, the power, the jurisdiction of the English Sovereign, and therefore every child born in England of alien parents was a natural-born subject unless the child of an ambassador or other diplomatic agent of a foreign State or of an alien enemy in hostile occupation of the place where the child was born."

It is not up to an alien to choose whether he is subject to US laws.
