“Members of Obama’s cabinet and Congress want to go after Bush in criminal court. It is only going to get worse from here.”

Not going to happen.

Any thought of going after Bush will backfire. There are too many issues facing this administration on day one. They will not have the luxury of going after Barry Bonds when they should have went after Franklin Raines.

My guess is that Obama would love to prosecute Bush but will hold back for fear of it backfiring politically.

Remember, Jefferson Davis was never tried...the government was afraid that a jury wouldn't convict. If Bush was put on trial in DC, the jury would be a hostile one, but there would probably be 2 or 3 jurors who would be unwilling to send a former President to prison for policy differences being labeled crimes...at least the Obama Justice Department wouldn't be able to count on a guilty verdict.
