Burris Consulting With Attorneys After Being Barred From Senate

WASHINGTON -- Roland Burris headed to Capitol Hill Tuesday to demand a seat in the 111th Congress, insisting that if he isn't allowed to take the oath of office as the next senator from Illinois, the Senate could have a lawsuit on its hands.

Participating in the theatrics, Burris was greeted by Sergeant at Arms Terrance Gainer, a door-keeper and an official from Senate Majority Leader Harry Reid's office before going to the appointment desk on the third floor and to the secretary of the Senate. There, his credentials were denied.

Burris was appointed by Illinois Gov. Rod Blagojevich, who was arrested last month and accused of trying to sell the vacated U.S. Senate seat previously held by President-elect Barack Obama.

I think that Burris should be allowed to run in a special election. I’m sure we could find a good Republican to run against him!

Blagojevich's pick has résumé chiseled in stone

(CNN) -- Anyone who doubts Roland Burris' qualifications to serve as the next senator from Illinois may want to head to Chicago's Oak Woods Cemetery.

There, Burris, whom embattled Illinois Gov. Rod Blagojevich appointed to succeed President-elect Barack Obama in the Senate on Tuesday, has erected a granite mausoleum listing his many accomplishments.

Under the seal of the state of Illinois and the words "Trail Blazer," Burris, 71, has listed his many firsts in granite, including being the state's first African-American attorney general and the state's first African-American comptroller.

The memorial also notes that Burris was the first African-American exchange student to Hamburg University in Germany from Southern Illinois University in 1959.

There appears to be enough room to add "U.S. senator" to the memorial, but Burris may never get a chance to serve in Washington.

A Senate Democratic aide told CNN on Wednesday that plans were in the works to prevent Burris from being seated in the Senate.

After Blagojevich made the surprise move to appoint Obama's successor, Senate Democrats praised Burris but said they could not accept any appointment by Blagojevich after his arrest on corruption charges earlier this month. Federal prosecutors say he conspired to "sell" Obama's Senate seat for campaign donations and other favors.

Burris should have marched right across the street to the Supreme Court.

Sounds like he's headed for some courthouse......(snicker)

Excerpt:

Burris told reporters on Monday that he was considering a walk over to the courthouse to file papers asking the court to admit him if he is denied the seat. But he wasn't going to be disorderly in the Senate.

"I'm not going to make a scene," Burris said. "I don't want to give you all a circus."

Well, technically it's not a federal usurpation of state power. Quite the opposite. The Secretary of State of the State of Illinois must certify the appointment, and he has refused to do so. So therefore, the US Senate is simply respecting and upholding the State law. If the Senate seated him, THEN they would be usurping power from the State of Illinois.

My, we do live in interesting times...

An alternative approach would be to point out that the Democrats caused the last black senator to resign from the Senate and now that the Senate has no blacks in it, the Democrats intend to keep it that way!

Nope. See 10 ILCS 5/25

(10 ILCS 5/25‑8) (from Ch. 46, par. 25‑8)
     Sec. 25‑8. When a vacancy shall occur in the office of United States Senator from this state, the Governor shall make temporary appointment to fill such vacancy until the next election of representatives in Congress, at which time such vacancy shall be filled by election, and the senator so elected shall take office as soon thereafter as he shall receive his certificate of election.
(Source: Laws 1943, vol. 2, p. 1.) [emphasis added]
Why a certificate of election for an appointment? Answer: one is not required, not until Burris stands for the seat in 2010. As far as appointments go, the Sec of State is required to record them, not certify them. There is no "two man rule." Burris should wave his appointment letter in the air and head for SCOTUS.

I believe that was severely limited in the case of Adam Clayton Powell.

In this post NonValueAdded quoted Illinois law which says that the Illinois Sec. of State only has to certify an election but not an appointment.

Actually Biden is not President of the Senate until noon on 1/20. Till then he’s another Senator - I don’t think he’s resigned his seat yet.

I'd believe that the 17th Amendment rules on the matter:

When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.

So long as IL legislature allows a guvna to appoint a Senator to fill a vacancy.....Burris is a lawfully appointed Senator and Harry just trampled not only on the Constitution, but on the rights of the People of Illinois.
