Nah, if they rewrite the constitution, they’ll be at least partially bound to abide by what they’ve written. Much better to just ignore it, or discover emanations and penumbras. That way it gets discredited.

It has to be ratified by 2/3 of the states though.

Luckily, it still takes 2/3 of the states to ratify changes to the Constitution. And it takes them a long time. They could never get the equal rights amendment passed.

Maybe those old guys really did know what they were doing when they spent all that time drafting the original. I am continually amazed at the timelessness and brilliance of the Constitution.
