Obama lost the argument, at least among rational people who follow the available evidence. If he wins the “battle” or “war” it will be because our institutions are too weak or cynical to confront him. But as Yogi Berra wisely noted, “It ain’t over till it’s over”.

They, discreetly, will let both political parties know that in future, they had *damn* well better vet their candidates, because if they try this stunt again, the SCOTUS will shoot them down without hesitation, and long before the end of primary season.”

There is no evidence I am aware of to support your personal speculations. So far as I know SCOTUS doesn’t issue discreet communications to political parties, just public rulings. And so far what they have done is fail to issue injunctions or grant certiorari. The next event is Congress counting the electoral votes on January 8th. Will one Congessman and one Senator rise to object, and force a roll call vote? We will soon know the answer to that question.

Don’t hold your breath. And don’t for a minute think that Washington works in a straightforward manner. They don’t. The SCOTUS are just as tied in to the machine as anyone else, and don’t hesitate to let the pols and the parties know what they are thinking.

It’s essential, if you think about it. Nothing illegal or unethical about it.
