Unfortunately, because Donofrio isn’t arguing the legitimacy of the birth certificate, but simply the dual citizenship and split loyalty issue, I doubt we’ll see any resolution to the birth certificate issue come out of this today. I have a feeling SCOTUS will simply go back to Article 1, Section 8 authorizing congress to define citizenship standards and dismiss Donofrio’s claim.

You may be correct. My thinking is that the SC knows that this is an issue that won't go away and that will only get worse if it is not addressed prior to Jan 20th. If they think like a chess player they will take on the case now.

Can you explain how that would provide a basis to dismiss? Congress has not legislated anything that would help Obama.
