Ex Post Facto Ex post facto is generally accepted to mean making something illegal which was legal when it was done. Congress can, and often doesn pass laws that take place retroactively. A prime example would be the recent law which protected the telecom companies from prosecution for providing call information to Homeland Security.

Well, I think that only prohibits criminalizing behavior that wasn’t criminal at the time, so I don’t think it would apply.
