Better late than never.
The trouble as I understand it is that McConnell v. FEC already tried that issue. Congressman Billybob points out that Justice Kennedy was in the minority of the 5-4 decision which upheld McCain-Feingold by siding with the FEC against Senator McConnell in that case. And that means that a rehearing of that case would presumably go the other (right) way now that Justice Alito is on the bench and Sandra Day O'Connor is not.

The case should always have been about the fact that the self-proclaimed "objectivity" of journalism is not proven, and could never be proven even if it were true. And that it is possible to prove that it is false.
