After being denied, dismissed and otherwise turned back in the Superior Court of New Jersey, Appellate Division, and the New Jersey Supreme Court, retired lawyer and professional poker player Leo Donofrio is taking the ultimate gamble and bringing his eligibility-related action before the United States Supreme Court. Donofrio, however, alleges that he has already been dealt a poor hand.
THE CASE
In his action filed against New Jersey Secretary of State Nina Mitchell Wells, Donofrio contends that Wells has not fulfilled her duty as Secretary of State to independently verify the constitutional qualifications of the presidential candidates before placing them on the ballot in the Garden State. Specifically, Donofrio notes in the brief accompanying the Application for Emergency Stay filed with the U.S. Supreme Court, Wells was required by N.J.S.A. 19:13-22 to make a statement in which she certifies and signs off on the names of the candidates on the ballots. The statute, in relevant part with emphasis added:
The Secretary of State, not later than eighty-six days before any election whereat any candidates nominated in any direct petition or primary certificate of nomination or State convention certificate filed with him are to be voted for, shall make and certify, under his hand and seal of office, and forward to the clerks of the several counties of the State a statement of all such candidates for whom the voters within such county may be by law entitled to vote at such election.

A newspaper annoucement is not a birth certificate. He may be a natural born citizen, but there is enough questions being raised about this.
I want to know why Obama and the DNC are blocking the release of this document.
Also, I want to see supporting documentation from the hospital.
Because of Obmama’s actions in this regard I am very suspect. This may turn out to be gotcha by Obama, but I want to know.
The fact that the court ruled that Berg had no standing in this matter is very disturbing. If the american people have no standing in this matter then who does? We have the most to lose if a fraud is president.

No, it is a certificate of nomination not eligibility. It does not mention anything about being a natural born citizen.
Every candidate is require to submit this document once they have nominated them.
This document appears to be silent as to qualifications.
If it turns out BO is a fraud this election was a fraud and we should start over. Bush stays in office until we nominate, and revote. I see no reason this could not be done in a month. East of the Rockies votes for a nominee on Thursday and West of the Rockies votes for a nominee on Friday. Monday we get the results and the two with the most votes are the nominees. We vote two weeks later. The DNC should be responsible for returning all money generated over the two years.
It’s interesting that foreign born socialist candidate Roger Calero was removed from some state ballots and not others.
He admits to being foriegn born yet stayed on the ballots of some states. The slope is getting slippery.
This still does not make the question go away.
Why won’t Obama release the birth certificate and supporting documents from the hospital? Why are they spending millions of dollars to fight this in court?

Would never happen, just as a judge in NJ would never go against a Democrat-elect, but if there were another election Hillary would be the candidate, she’d win in a landslide, and I’d sleep much better at night. I can’t believe I just wrote that, but it’s true!
ANd remember BIden’s comments about serving with McCain....or was that just the SNL skit???
NJ is one of the states that allowed an admitted foriegn born candidate to remain on the ballot.
If after than the House must vote on the top 3 receiving votes from the Electoral College. If only Obama was voted by the democrat electors than McCain wins by default. The only out would if the democrats saw this as a real possiblity than all they would need is an elector to vote for other than Obama.
Uh? Green Party Candidate, McKinney?
And what is the FEC’s defence on this ?
