I think Fairness Doctrine would be held unconstitutional as it regulates “content”. Courts have stricken down attempts to balance “content” on cable TV regulation, which is outside FCC but “franchised” by municipalities.

There is lots of case history pertaining to the Fairness Doctrine, including from the S.Ct. (See the Red Lion v FCC). No court has yet to hold it's unconstitutional. When the FCC backed off the Fairness Doctrine in the 80's it did so voluntarily, not because any court ordered it to. In fact, when they did it many in Congress wanted legislation to require the FCC to reinstate it, but Reagan would not sign, nor any of his successors, and there was never enough support to defeat a veto.

Of course all the case history dates back to a time when there were not 1000 cable/sat channels, Sat radio, Internet, etc, so it's hard to say, especially with the titled judiciary we seem to be creating.

At any rate the Fairness Doctrine will have to reinstated before we'll find out. I'm and sure Rush, Hannity, and their syndicators and stations are already lawyered up and ready to file suit the day it goes back into effect.

Yes, I noticed that too. In retrospect, he didn’t behave like a candidate who had the fire in him to want to win. And when, at his rallies, he would say to his supporters, “You don’t have to fear Obama as your president. He is a kind and decent man.” McCain just kept reminding me of why I didn’t vote for him in the primaries! Governor Palin was the best thing that happened to that ticket.

I remember writing an opinion in one of my graduate sociology classes. It was on an interesting study of (self-segregated) subjects comprised of Hispanic groups who have yet to fully assimilate completely to (some aspects of) the American culture. There was much explanation for such, including at its core an inferiority complex that remained complacent——thus allowing for a rich breeding ground in which gang participation fosters, mainly for the sense of belonging it provides to these affected individuals. Although violence often times prevails within these groups, it rarely did so across the board. Again, this was an opinion I wrote on a published study-—and not a study I replicated.

(Sorry, didn’t mean to get so wordy there.) :-)

The my way or the highway voters are going to get us all killed one of these days. I wish people would fight it out in the primary and then be more pragmatic in the general...

She certainly was... and him not coming out and defending her makes me sorry I even voted for him in the general (well almost)... I want his senate seat gone to a new Republican in 2010.
