Yes - Berg apparently filed in both the Third Circuit and the Supreme Court. This is from the Third Circuit part of the case. AND, it only addresses the emergency motion to stay the election, not the appeal itself.

Your saying that the filing that I’m refering to is not the emergency motion to prevent the election but it is the motion to apeal the lower courts ruling to demand Obama release his original birth certificate to prove he is qualified to be POTUS.
