Does anybody know what the actual protocol is for a president-elect to prove he/she meets the constitutional requirements to take the oath of office? Who’s in charge of ensuring those requirements are met? The Chief Justice of SCOTUS who does the swearing in?
The problem is, there is no protocol. The issue has never come up, only a few candidates were born outside the US, all to two US Citizen parents, and none of them, including John McCain, have hidden the details of their birth.
Thus NO ONE is in charge of verifying eligibility. Although State officials control ballot access, and could establish a requirement for proof of eligibility. But they have not done so.
Traditionally the Chief Justice does the swearing in, but that's not required. LBJ was sworn in by a Federal District Court Judge, Sarah Hughes.. (a Kennedy appointee, who latter went on to run Dallas county jails from the bench, and also was the original judge in Roe Vs. Wade)
