That is a lie. While the winning side often presents an order based on the reasoning, the judges tells the party his reason for his decision. If Surrick didn't write it, he violated numerous provisions of the code of judicial condut and probably obstruction of justice. If he had extra judicial contact with a party, he must recuse himself from the case.

What now makes he whole Berg thing somewhat suspect is the result. If this was a “Hillary Plan” it seems it would have been put in front of a more “reliable” judge.
You don't do something like this unless you already know what the outcome will be.
This was likely a trap for McCain,draw him into saying something publicly about Obama’s citizenship status then “BANG” Obama whips out a BC and McCain looks foolish. Obama seals the deal !
