Good question. They have ignored it so far, now it will be more difficult to do so.

Well they lived close to each other in New York at the same time.

Obama’s childhood friend and mentor Frank Marshall Davis knew Thomas Ayers, and some think that Davis and Ayers sent Obama to New York on purpose.

Actually, it doesn’t say run. It says eligible. But, as per the state ELEC offices, the party putting the candidate on the ballot has to vet the candidate.

This is where Philip Berg’s suit has a standing. They didn’t respond to Berg’s suit either which was two parts. Fine, if Berg doesn’t have a standing on vetting Obama, so be it. But he, as a democrat, did have standing in challenging the DNC. The judge has no right throwing that out.

If a person is not eligible TO the office how could they run FOR it?

Anyway,
I think the judge sort of summarily punted the whole thing by saying his court didn't have jurisdiction on the case. What followed was really irrelevant, why include it? Unless you had a political point to make, and a platform for an attempt at discrediting Berg.... Who wrote this Opinion?

Best thing I can think of is that there simply does not exist a mechanism, there is no agency, there is no Secretary to who this duty falls. It falls to the POLITICAL PARTY to vet their candidates. And it looks like the DNC has failed in this case, wantonly so.

I think the failure to dismiss initially, compared with the subsequent opinion rendered, speaks volumes. THat said, there have been some criticisms of the quality of Berg’s actual complaint here on FR which may have impacted the credibility of the suit overall, viewed from outside.

What I am saying is that, when one person (presumably with family) is unexpectedly placed under the gun with a huge inverted pyramid of pressure upon them, and possible consequences which clearly could include life or death for people related to them (unless you think no one ever kills for the highest political stakes in the world), you will find that most folks don’t want to be martyrs, and particularly don’t want their families to live under collateral involuntary martyrization threat.

Also, in the time since the original suit, the election situation has changed dramatically with the financial crisis (ongoing). The judge, like many, may consider obama’s election much more likely now and may have simply looked for the noble way to bow out.

Oops. Your first sentence was correct, but your simile was not. The same God that gave the 10 Commandments also gave the Golden Rule, “Do unto others as you would have them do unto you.” The underlying Source and Lawgiver was the same in both cases.

Something doesn't work right here.

You and I and just about everyone on FR knows why "something doesn't work." That "something" is the leadership of today's Democrat Party, which thinks that the Constitution of the United States doesn't apply to them, and they can therfore nominate a constitutionally ineligible candidate for POTUS! This is so brazen and so unprecedented an attempt at a dictatorship that it seems we don't have appropriate laws and procedures on the books to deal with it.

Interesting, isn’t it? Are we to assume the lack of any clear leak on this topic means that he was born in hawaii regardless of what other data appears on his colb, or that State is so heavily politicized that this info could be successfully suppressed?

The crazy thing is, I don’t know which is more likely.
