Anyone can file any lawsuit in any court, and we should not assume anything just because the court cannot instantly throw out the crapola because the plaintiff lacks standing or because the suit is otherwise defective.
All I know is that Obama eliminated his competition in Chicago by disqualifying them on candidate registration technicalities. If this birth certificate problem ever sees the light of day, I hope the same courts have no mercy on his sorry butt.
