Judges interpret the law as it has been written by elected representatives of the people.

Judges do NOT 'provide fairness and justice' unless it is within the existing law - in this case, the Constitution of the United States.

I screamed, "No, you freaking idiot. Federal judges have only one obligation: To read and apply the Constitution and laws of the United States as written. Some time the result is fair and just, and sometimes the result is unfair. The remedy is not through judical fiat, but through the legislative process." That's exactly what happened in the "equal pay case." The SCOTUS ruled against the employee because the statute of limitations as set by Congress had expired. Congress had the chance to amend the statute to legislatively overrule the SCOTUS, but chose not to. The system worked, and while the result may seem unfair, cases are dismissed every day across the country at the federal and state level on the grounds that the statute of limitations has expired.
