That's exactly what happened in the "equal pay case." The SCOTUS ruled against the employee because the statute of limitations as set by Congress had expired. Congress had the chance to amend the statute to legislatively overrule the SCOTUS, but chose not to. The system worked, and while the result may seem unfair, cases are dismissed every day across the country at the federal and state level on the grounds that the statute of limitations has expired.
