There’s no good answer. If you elect justices, then you will get a few Obamas and Clintons on the court. Or Slick Willies. Or people who know as much about law as I know about Japanese Macroeconomics. It would be a real mess, and the SCOTUS is way to powerful as it is. We need to work on reigning in it’s power.
All we need is one more conservative. We are too close to give up!
As with all administrations, an Obama Administration will have two factions- the ideological and the pragmatic. Who a President Obama appoints to key advisory positions will give us definite signs.
Oh I am not giving up on McCain winning really. He may very well win, but what effect will it have? 8 years of Bush and we can thank him for some tax cuts and 2 great Supreme Court choices. This is not to mention where Congress has its priorities. I hope, if McCain wins he can put at least 2 justices on the court in the mold of Alito/Roberts, and then the Court can guide the country back to the Constitution, as I do not foresee the office of the President, or Congress to guide us even remotely back in that direction.

We could get Obamas and Clintons in the White House as it is, and presidents are more important in the short run than justices. While the general public knows very little about stare decisis and Constitutional law, how much do they really understand about military strategy and geopolitics? We have to stop treating the law as if it’s not politics, but rather some sort of scholarly pursuit. They’re politicians. They have their own ideas.
Shoot, McCain would probably appoint Larry Tribe. He’s already his go-to guy when he needs legal advice.
Conservatives who think McCain would move the Court any direction but Left are deluding themselves.

absolutely. I think this might even be more important than who is CIC...I mean if the Supreme Court can grant rights to terrorists I’d say we want McCain picking those justices!
