AP Refuses Secret Service Request for Palin's "Hacked" Emails

Hackers broke into the Yahoo! e-mail account that Republican vice presidential candidate Sarah Palin used for official business as Alaska's governor, revealing as evidence a few inconsequential personal messages she has received since John McCain selected her as his running mate.

See post #34. They are guilty of about 1000 counts of obstructing a criminal investigation, another 1000 counts of using emails known to have been illegally obtained.

At 5 years jail time and $500 fine per count, they need to rethink their strategy.

In fact, if you, today, knowing their were unlawfully obtained, posted the content of one of Palin's emails, you have committed a felony.

I doubt a copy of a forwarded e-mail qualifies as a stolen good

The spin will be that Palin was using private email for government business.

The second line of spin will be that any VP candidate who is not smart enough to keep her email account from being hacked, has no business running.

Like I said, the Pentagon Papers case prevented the government from punishing the NY Times for publishing classifed materials. You don't think it will be used by the AP's $750/hour 1st Amendment lawyers to shut down any threatened criminal charges here?

If they will not comply with the Secret Service, send the FBI to raid their offices. AP appears to think itself above the law.

Entirely different issue. There is a very strong argument that the Pentagon papers were not actually classified and were only designated as classified to cover up information embarassing to the government. That is illegal [it is not the color of the stamp that determines classification, but the nature of the material]. Except for a few well defined categories, government information is owned by the public.

This is information obtained through an illegal electronic intercept. Period.

This is no different.

Erwin Chemerinsky (LIB Law school dean, on Hewitt last night) said this IS different - 4th estate and freedom of speech will protect AP and anybody else that reproduced and makes available to the public this STOLEN material.

The hacker, however, has committed a felony, will be caught, and if GWB has any gonads, will be prosecuted to the fullest extent of the law.

I hope he mentioned that it was employees of the DNCC headed by Chuck Schumer who did it. They were so disappointed when they found no wrongdoing in any of Steele's accounts...

What law have they broken? The Anti-American Pucks have broken many laws and the one I am about now is that the Secret Service asked them to identify the email thief and they have refused to do so. They have NO right to publish stolen property nor do the have the right to receive stolen property. If they received stolen property they should be in jail including their lawyers.

So any media that used the Anti-American Pukes AP I will stop reading and using including the web pages. And I write ant tell them that.
