Libertarian presidential nominee Bob Barrs campaign filed suit Tuesday seeking to remove Republican John McCain and Democrat Barack Obama from the ballot in Texas, alleging that the two major candidates missed the deadline for officially filing to be on the ballot.
The lawsuit by the former Republican congressman from Georgia claims that neither McCain nor Obama met the requirement of Texas law that all candidates provide written certification of their nomination before 5 p.m. on the 70th day before election day because neither had been formally nominated by their respective parties in time.
That would have been Aug. 25. Obama did not accept his partys nomination until Aug. 28, McCain his on Sept. 4.
The lawsuit states: The hubris of the major parties has risen to such a level that they do not believe that the election laws of the State of Texas apply to them.
Pat Dixon, chairman of the Texas Libertarian Party, issued a statement saying, Libertarian principles require personal responsibility for your acts and failures. Obama and McCain failed to meet the deadlines. They must follow the law like everyone else.

You do know candidates can not legally keep donated money or spend it on themselves, right? It is not like Barr or whatever candidate (including McCain and Obama) is going to take a Hawaiian vacation with their respective remaining donated money after the election.
I don’t understand why libertarians don’t work within the Republican party. The two parties are natural allies and compliment each other. If the Republican Party can have moderates and religious conservatives, then they surely can have libertarian Republicans.

What would stop voters from writing in McCain or Obama? Even if the lawsuit were successful which is highly unlikely, McCain would still carry the state with the write-in votes. It would just take Texas a long time to count the ballots.
Of course, I have very intimate knowledge of this- however, I also know that you can file flights, hotels, meals, some entertainment, etc all as campaign expenses. You can basically live high off the hog for months all on your donor's dime, then, if you have anything left, move it into a personal PAC account and file similar expenses for PAC 'activities'. They don't need to take a Hawaiian 'vacation', they can claim it is a campaign or PAC related event, live just like it was a vacation, but expense it against the campaign.
Texas is red, it is in the bag for McCain, Obama wasn’t going to get those electoral votes, anyway. Can McCain win without Texas’ EVs?
Actually it must suck to be the head of a party and be dumber than a box of rocks. Barr looks like a complete idiot for not researching this before filing.
In Texas you have to file to be a write in candidate too.
Because the rules in Texas say you have to file by the 26 or file an extension- the extension is part of the rules. Barr is challenging that part of the rule.

Wow, he must really want Obama to win. Never would have thought that of Bob Barr. See, drop McCain and Obama from Texas, and what happens? McCain can’t get the 270 electoral votes to win, since most polls show Texas is firmly McCain’s. Obama, on the other hand, CAN be projected to win without Texas, if the breaks go his way in toss-up states. So all Barr accomplishes with this is basically making it easier for Obama to win. Nice move!

If you will permit me, I beg to differ. I know what you are trying to say, but I think that in THIS case, Barr is so enamored of his own supposed intelligence that he cannot be embarassed. Did you ever know someone who was SO stupid that no matter what you said to them you could not insult them? That’s Barr. He’s a legend in his own mind!
