I thought that the Judge had ruled that Berg did have standing, but I might be mistaken.

Then ? if that is the case, why then should he even bring the case to court if he had a weak case to begin with and lack of evidence ?
Most lawyers should know that, and ex specially in this kind of case of magnitude he should know he better make sure he has the evidence.
