Well I know his father wasn’t an American, but I’m at a loss to understand what his mother’s age has to do with anything. Was his mother not a native-born American ? If so, he’d still technically be an American citizen even if born on foreign soil (unless she had renounced her citizenship). I think the bigger issue here is the fraud itself in covering up his birth records and subterfuge on place of birth.
No... I don't have the statute handy but I bet someone will post it.
Here’s some information that sheds light on the matter:
Law in effect at the time only granted natural-born citizenship to a child of one American parent born overseas IF that parent had resided at least ten years in the U.S., of which five had to be after the age of 16 — i.e., Ann Dunham was not old enough to automatically confer citizenship on her son.
You are confusing “Citizen” with “Natural Born Citizen”. Two different things when running for President.
She would have had to have lived as a citizen for at least 5 years after turning 21, unless his father was a citizen. Someone up thread posted the actual statute I think.
As I understand the law, a child that is born to an American citizen while abroad is not a “Natural-born” (IOW born in the USA). Exceptions are for children born to Americans abroad on US government business (military and diplomats). Furthermore, if one of the child's parents is a foreigner, the American parent MUST have resided in the USA for at least 5 continuous years after age 14, in order for the child to have a claim to ANY US citizenship.
IF ( and I think obama was probably born in Hawaii) he was born in another country, his mother was only 18 or 19 and therefore could not pass on citizenship.
The Constitution requires the President to be a "natural-born" American.
