I'm not keen on recess appointments in any event - I think the government (admin and Congress) have been acting unconstitutionally in this area for generations. If the Senate is in session, it should act on nominations (up or down) instead of playing footsie. The recess power is supposed to be a concession to the reality that the Congress used to meet for only a month or two out of the year, and executive offices needed to be filled. The current reality is that there is a wild proliferation of executive offices (many of which can go unfilled for extended periods) and a dysfunctional/irresponsible Senate.
