Is U.S. Bioterror Attack Just A Matter of Time?

The overriding question is whether the U.S. is “ready” for a bioterror attack. The answer could well rely on the “other” question of what bio-agent and what’s the source? In 1991, 40,000 Russian scientists dispersed throughout the World, with knowledge of what the U.S.S.R. was doing in chemical and biological weapons. The question is to whom did they sell their knowledge? Some believe former Soviet scientists sold technology to countries like Iran, Syria, and North Korea. Lurking is the spectre of al-Qaeda, a group that the Pentagon says continues to pursue biological weapons.

Another scenario is an outbreak of a pandemic. How would the U.S. deal with an infectious disease outbreak? The picture, despite reassurances, is not pretty. Until now, the U.S. has experienced two major biological attacks.

In 1984, the Bhagwan Shree Rajneesh and his followers attempted to take over the town of the Dalles, Oregon by contaminating salad bars in the town. In 2001, there was the as yet unsolved mystery of the anthrax letters that killed five people.

But the question of bioterrorism extends to potential threats against our food supply and our clean water resources. It also extends to the threat of outbreaks of diseases in our animals populations. Here, the concern are diseases that attack animals but that can jump to humans. These are referred to as zoonotic diseases. The World Health Organization defines zonnotic diseases as:

ARMY LIEUTENANT COLONEL PLEADS GUILTY TO PARTICIPATING IN WIRE FRAUD SCHEME ARISING OUT OF AL-HILLAH , IRAQ

WASHINGTON – Debra Harrison, a lieutenant colonel in the U.S. Army Reserves, pleaded guilty today to honest services wire fraud in connection with a scheme to defraud the Coalition Provisional Authority - South Central Region (CPA-SC) in Al-Hillah, Iraq, announced Acting Assistant Attorney General Matthew Friedrich of the Criminal Division.

Harrison, 50, of Trenton, N.J., entered her guilty plea today before the Honorable Mary L. Cooper at the U.S. District Court for the District of New Jersey, Trenton Division. At the plea hearing, Harrison admitted that in August 2004 she received a Cadillac Escalade from Philip Bloom, a contractor at the CPA-SC. The Escalade was financed through a series of wire transfer payments, which form the basis of the wire fraud charge. Harrison also admitted that she took more than $300,000 from the CPA-SC while deployed there and that she used some of the stolen money to make improvements at her home. Harrison also admitted that in July 2004 she helped to move unregistered firearms from a hotel in North Carolina to the home of Robert Stein, a co-conspirator who worked with Harrison at the CPA-SC.

Harrison’s sentencing is scheduled for Nov. 19, 2008. Harrison faces a maximum penalty of 20 years in prison, a three year term of supervised release and a fine of $250,000.

On Jan. 29, 2007, co-conspirator Robert Stein was sentenced to nine years in prison for related charges of conspiracy, bribery and money laundering, as well as weapons possession charges, for his role in the same scheme. Stein was also ordered to forfeit $3.6 million for his role in the bribery and money laundering scheme.

On Feb.16, 2007, co-conspirator Philip Bloom was sentenced to 46 months in prison for related charges of conspiracy, bribery and money laundering for his role in the scheme. Bloom was also ordered to forfeit $3.6 million for his role in the bribery and money laundering scheme.

On June 25, 2007, Lt. Col. Bruce Hopfengardner was sentenced to 21 months in prison for conspiracy and money laundering related to this scheme. Hopfengardner was also ordered to forfeit $144,500.

On Feb. 1, 2007, Col. Curtis Whiteford, Lt. Col. Michael Wheeler, and civilians Seymour Morris Jr. and William Driver were charged in a 25-count indictment for related charges including conspiracy, bribery and money laundering in connection with this scheme. Trial in this case is scheduled to begin Sept. 9, 2008, in Trenton.

These cases are being prosecuted by Trial Attorneys Ann C. Brickley and John P. Pearson of the Criminal Division’s Public Integrity Section, headed by Section Chief William M. Welch II. The cases are being investigated by the Internal Revenue Service Criminal Investigation, Special Inspector General for Iraq Reconstruction, U.S. Immigration and Customs Enforcement at the Department of Homeland Security and the FBI-Washington Field Office.

PCP Trafficker Sentenced to Life in Prison
—Defendant Arranged for PCP to be Smuggled by Drug Couriers on Commercial Airlines—

Washington, D.C.– Troy Hopkins, a 31-year-old Lanham, Maryland resident, was sentenced today by U.S. District Court Judge Reggie B. Walton to life imprisonment for his role in a large-scale PCP distribution network. Hopkins, a career offender, was convicted of narcotics conspiracy in November of 2007, after a two-month trial.

The government presented evidence at trial that established that Troy Hopkins, one of the principal leaders of the conspiracy, developed relationships with California PCP suppliers who sold gallon quantities of the drug. Hopkins and other co-conspirators then used drug couriers – often young women – to carry gallons of PCP aboard airline jets that flew from Los Angeles International Airport, Long Beach Airport, and Burbank Airport into Baltimore Washington Thurgood Marshall International Airport and Dulles International Airport. These drug couriers carried the PCP in mouthwash, body lotion, or shampoo bottles packed in their checked luggage, while Hopkins took later flights to distance himself from the couriers during the transportation process. Hopkins alone made in excess of 25 trips to Los Angeles during a three-year period in order to purchase the PCP, and he established a network of more than 10 drug couriers. In a 24-month period alone, Hopkins and his co-conspirators were responsible for transporting in excess of 30 kilograms of PCP from California to the Washington metropolitan area.

Once the PCP arrived in the Washington area, local members of the conspiracy “cut” the PCP with car starter fluid in order to extend their profits. The conspirators then sold the PCP to wholesale customers. The PCP would be resold on the streets of the District of Columbia and Maryland. Hopkins made an estimated $20,000 to $40,000 profit per gallon reselling the PCP.

The prosecution was the result of a multi-year investigation and was led by the Federal Bureau of Investigation, and it involved the OCDETF and HIDTA task forces.

In announcing the sentence, U.S. Attorney Jeffrey A. Taylor commended FBI Special Agents Timothy Ervin, Tucker Vanderbunt, Kevin Ashby, Timothy Foster, Jesus Gomez, and John Bevington, and FBI Supervisory Telecommunications Specialist Daniel Wentz, Prince George’s County, Maryland Police Detective Sean Deere and the Prince George’s County Police Major Narcotics Enforcement Division, Calvert County, Maryland Sheriff’s Detective Scott Parrish, Drug Enforcement Administration Special Agents Amin Fard, John Haggerty, and Cindy Buskey, Supervisory Special Agent James Benicek, and Chemist Steven Demchuck, Los Angeles County Sheriff’s Deputy John Cater, Los Angeles Police Officer John Ashpaugh and Detective Daniel Armand, and Burbank, California Police Department Detective David Kleinfeld and Deputy U.S. Marshal Richard Kelly for their work on the investigation of this case. In addition, U.S. Attorney Taylor commended Paralegal Supervisor Mary Downing, and Paralegal Specialists Mia Beamon and Carolyn Carter-McKinley who assisted in the investigation and prosecution, as well as Litigation Support personnel Thomas Royal, Errol Spears, Tim Linder, Victim Witness Unit Specialist Dawn Tolson-Hightower and former Criminal Division Intern Ivanna Deyrup. Finally, U.S. Attorney Taylor praised Assistant U.S. Attorneys S. Elisa Poteat and Emory V. Cole, who investigated and prosecuted this matter.

LOBBYIST PLEADS GUILTY TO DESTROYING EVIDENCE IN PUBLIC CORRUPTION INVESTIGATION

WASHINGTON—A partner in a Pennsylvania-based lobbying firm pleaded guilty today to destruction of evidence, Acting Assistant Attorney General Matthew Friedrich of the Criminal Division, U.S. Attorney Jeffrey A. Taylor for the District of Columbia, Assistant Director of the FBI’s Washington Field Office Joseph Persichini Jr., and Special Agent in Charge C. André Martin of Internal Revenue Service (IRS) Criminal Investigation announced.

Cecelia Grimes, 43, of Parkesburg, Penn., pleaded guilty before U.S. District Court Judge Henry H. Kennedy Jr., in U.S. District Court of the District of Columbia. At sentencing, Grimes faces a maximum sentence of 20 years in prison and a fine of $250,000.

According to the evidence presented at the plea hearing, Grimes was a registered lobbyist whose firm submitted requests for appropriations to the office of a Member of the U.S. House of Representatives (Representative A). Beginning prior to October 2006, the FBI opened an investigation into certain activities of Representative A, including whether Representative A agreed to support appropriations requests made by Grimes’s firm in return for the payment of fees to Grimes’s firm by its clients.

As part of that investigation, on Oct. 16, 2006, FBI agents served Grimes with two grand jury subpoenas after questioning her in relation to the investigation. One subpoena was for her lobbying firm’s custodian of records and the other was for the custodian of records of another lobbying firm of which Grimes was the sole proprietor. Both subpoenas were issued on behalf of a grand jury of the U.S. District Court for the District of Columbia. The subpoenas instructed the custodians of records to produce by Oct. 27, 2006, a series of records, including all documents relating to: several of Firm A’s clients; Representative A; Representative A’s campaigns; or Grimes’s travel.

Evidence presented at the plea hearing revealed that within six days of the FBI’s service of the two grand-jury subpoenas, Grimes placed some documents that she had stored in her house into trash bags, which she then brought to the front of her house for collection as garbage. These documents included items related to Grimes’s travel and to Representative A’s campaigns. FBI agents retrieved the garbage bags that contained the discarded documents, which were never produced to law enforcement authorities.

Evidence also presented at the plea hearing revealed Grimes destroyed e-mails that were stored on her BlackBerry device. In early November 2006, Grimes placed her BlackBerry device in a trash can near a restaurant in Southeastern Pennsylvania. Grimes discarded her BlackBerry for the purpose of keeping the FBI from reviewing certain e-mails of hers that would be of interest to the FBI.

The case is being prosecuted by Assistant U.S. Attorney Howard Sklamberg, Trial Attorney Gregory C.J. Lisa of the Criminal Division’s Organized Crime and Racketeering Section, Trial Attorney Armando O. Bonilla and former Trial Attorney Natashia Tidwell of the Criminal Division’s Public Integrity Section. The case is being investigated by the FBI and IRS Criminal Investigation. The investigation of this case is ongoing.

FORMER TOP SAS CARGO GROUP A/S EXECUTIVE AGREES TO PLEAD GUILTY TO PARTICIPATING IN PRICE-FIXING CONSPIRACY

WASHINGTON — The former highest-ranking cargo executive in the United States for SAS Cargo Group A/S (SAS), a Scandinavian-based airline, has agreed to plead guilty and serve six months in jail for participating in a conspiracy to fix prices for air cargo rates, the Department of Justice announced today.

According to the charges filed today in U.S. District Court for the District of Columbia, Timothy Pfeil, while in his capacity as SAS’s area director of sales and marketing for North America, conspired with competitors to fix the rates charged to U.S. and international customers on air cargo shipments, in violation of the Sherman Act. In accordance with the plea agreement, which is subject to court approval, Pfeil has agreed to cooperate with the Department’s ongoing investigation.

In July 2008, SAS pleaded guilty and was sentenced to pay a $52 million criminal fine for conspiring to fix prices on air cargo rates.

The air cargo conspiracy affected billions of dollars of consumer and other goods –including produce, clothing, electronics and medicines –shipped by air cargo companies. Including today’s charges, nine companies and two executives have been charged in the Antitrust Division’s ongoing investigation into the air cargo industry and more than $1.2 billion in criminal fines have been imposed.

“The air transportation of industrial and consumer products is a critical part of the global economy,” said Thomas O. Barnett, Assistant Attorney General in charge of the Department’s Antitrust Division. “The Department will continue its investigation of this important industry, and we remain dedicated to aggressively pursuing all those who engage in criminal conduct that harms American consumers.”

According to the charges, beginning at least as early as January 2005 and continuing until at least February 2006, Pfeil and his co-conspirators:

Participated in meetings, conversations and communications in the United States and elsewhere to discuss the cargo rates to be charged on certain routes to and from the United States;

Agreed during those meetings, conversations and communications, on certain components of the cargo rates to be charged for shipments on certain routes to and from the United States;

Charged cargo rates in the United States and elsewhere in accordance with the agreements reached; and

Engaged in meetings, conversations and communications in the United States and elsewhere for the purpose of monitoring and enforcing adherence to the agreed-upon cargo rates.

In August 2007, British Airways Plc pleaded guilty and was sentenced to pay a $300 million criminal fine for conspiring to fix cargo rates for international air shipments, including to and from the United States, and to fix passenger fuel surcharges for long-haul international air transportation, including between the United States and United Kingdom. The same day, Korean Air Lines pleaded guilty and was sentenced to pay a $300 million criminal fine for conspiring to fix cargo rates charged to customers in the United States and elsewhere for international air shipments and to fix wholesale and passenger fares for flights from the United States to Korea.

In January 2008, Qantas Airways Limited pleaded guilty and was sentenced to pay a $61 million criminal fine for its role in a conspiracy to fix cargo rates to customers in the United States and elsewhere for international air shipments.

In May 2008, Japan Airlines pleaded guilty and was sentenced to pay a $110 million criminal fine for conspiring to fix rates for international cargo shipments.

Also in May 2008, Bruce McCaffrey, Qantas’ former highest-ranking executive employed in the United States, pleaded guilty to fixing cargo rates to customers in the United States and elsewhere for international air shipments, and agreed to serve eight months in jail, and to pay a criminal fine.

Along with SAS, in July 2008, Cathay Pacific Airways Limited ( Cathay), Martinair Holland N.V. (Martinair), Société Air France (Air France) and Koninklijke Luchtvaart Maatschappij N.V. (KLM Royal Dutch Airlines) pleaded guilty to conspiring to fix prices on air cargo rates. Cathay was sentenced to pay a $60 million criminal fine, Martinair was sentenced to pay a $42 million criminal fine, and Air France-KLM, which now operates under common ownership by a single holding company, was sentenced to pay a $350 million criminal fine.

The ongoing investigation is being conducted by the Antitrust Division’s National Criminal Enforcement Section and the Federal Bureau of Investigation (FBI). New York Jihad… It could be a hoax but it could also be an actual terror threat. At this time, no one is sure but investigators are not taking any chances. Cards that look like birthday invitations, sent to seven New York residents including a Fox News producer contained a serious terror threat and are now being tested for fingerprints and DNA.

The story bears some similarity to the Jihad Boom postcard story followed last year.

In September of 2007, investigators in Marion County, Fla., announced that they were searching for the author of nine postcards sent to different schools on the same day, with the words “9-11? 10-10 ‘Jihad-Boom” and cartoons drawn by hand, of a building being blown up with people inside.

Authorities Investigate Church Explosion And Death

(Bates City, MO) — Authorities are waiting on autopsy results to learn more about what killed a man, whose body was found in a church explosion.

Saturday afternoon, firefighters were called to Kingdom Hall in Bates City, after an explosion sparked a fire.

After putting out the flames, firefighters discovered the body.

Investigators suspect the man committed suicide.

PHOENIX (AP) — An electrical explosion at a central Phoenix high rise knocked out the network servers at three regional Maricopa County libraries, forcing them to close.

A large commercial breaker box shorted Saturday afternoon, causing a small explosion while several people were doing electrical work at the high rise. One worker had minor burns.

Passing motorists found Officer Nocolas Romero’s patrol car on fire in the median of I-19 near the Papago Road exit, and pulled Romero from the car through the windshield.
