You're closer to the truth than you realize. Since they had success with the sport pilot problem they see a loophole that can be used in other venues. They just enacted a new rule. Ultralight aircraft and pilots need no registration nor license. Your right to fly without government interference is "protected" while you are limited to turn of the century aircraft.

Yes, but there is no enumerated individual right to fly a plane. Thus the right would be subject to a lessor degree of scrutiny. A public safety justification *might* be sufficient, especially where there are provisions for continuing to exercise the right without endangering the general public with falling aircraft.
