The Supreme Court did not rule against the death penalty for cases such as this. Murder still warrants a death penalty.
The ruling excludes rape (including of a minor) from capital punishment on the basis of cruel and unusual punishment.
The Bible does not make rape a capital offense (except if the victim is a married or betrothed female). It does, however, make kidnapping a capital offense.
I think that law makers should respond to the Supreme Court ruling by raising the severity of punishment for kidnapping.
That would not address crimes against children by incestuous step fathers or similar crimes, but it would deal with cases like this one in the event the victim survives.
Another helpful solution is for lawmakers to grant blanket immunity for victim’s close family members who retaliate against the perpetrators.
