My guess, however, is that when a Supreme Court vacancy occurs during a McCain presidency, Harry Reid et. al will send over a memo with a half-dozen names of militant liberals on it, with the message “Nominate one of these, and they’ll be confirmed. Nominate anyone else, and they won’t get out of committee.”

You could be right about that. I’m sure that weasel Reid will do just that if McCain is in office, I just hope he doesn’t cave to the Rats.

Chances are, one of the fascist living/changing/evolving-Constitution justices will be the next to go - hopefully Ruth "Buzzy" Ginsburg. In this case, if McCain is in, can't the court just function on the number that's left if the Democraps won't approve? That would be fine with me.

That may be so. But if McCain wants to - a fact not yet in evidence, but what are we to do otherwise?- he can simply dump a conservative justice' name on the Senate and walk away. He could even nominate Congressman Billybob. Assuming the vacancy is created by the 88 yo (and counting) Justice Stevens, failure to confirm a new justice will leave SCOTUS deadlocked whenever Kennedy votes liberal. Meaning that the subordinate court's ruling would stand in such case.

Make an awfully good issue to run on in the congressional races in 2010 . . . and a necessary one to avoid a primary fight in '12 if McCain wants to keep his options open for a reelection run - as, let's face it, anyone who's proud enough to run for POTUS is proud enough to want to do.
