STATE OF OKLAHOMA

2nd Session of the 51st Legislature (2008)

HOUSE JOINT

RESOLUTION 1089 By: Key

AS INTRODUCED

A Joint Resolution claiming sovereignty under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution.

WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows:

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."; and

WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, today, in 2008, the states are demonstrably treated as agents of the federal government; and

WHEREAS, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and

WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and

WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States.

NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:

THAT the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. THAT this serve as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.

THAT a copy of this resolution be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker

of the House and the President of the Senate of each state's legislature of the United States of America, and each member of the Oklahoma Congressional Delegation.

Yes, what your friend says is true but the one thing those materials won’t do is reach out and touch someone the same way a rifle does. If you want to touch just one person in the crowd, using a rifle sends a very distinctive message. It’ll cross language barriers in a fashion that no other tool even dreams of.

Perhaps true; but have you seen the new Federal Building that replaced the one Timothy McVeigh and his cohorts blew up?  It's quite impressive.  The Federal Seal, the object in the photograph, still stands on the site of the Murrah Building.  The system did what it does - it addapted and evolved.
 
The ability of the system to do violence far outweighs the ability of the citizenry to do violence.  George Orwell illustrated that fact via his classic 1984. The Party of 1984 expects revolt, even wants it; and maintains the military industrial complex by which it expects to profit from that revolt.  It is a calculated,  vicious, cycle. 
 
In the end, the collective hive evolves - whether it be via revolution or reformation.
 
Certainly the Federal Government needs systemic reformation; "It" needs to return to the intended purpose articulated by the writers of the Declaration of Independence:
 
"To secure these rights, men form governments" 
 
We the People - the individual citizens who comprise that government (and its collective corporatist extensions) need to be reminded of that - and make reforming "it" OUR priority;  We the People have the power to alter the institution from within - and redirect it back towards its proper purpose.   That power is squandered through our own apathy - and is best engaged via our own, personal, reformation.  By changing ourselves, we change the system.
 
The longest journey begins with a single, educational, step...

Have you read threads where the Amero dollar is mentioned? Seen where the trolls come out denying that the Amero dollar is a part of the globalist plan for the NAU, renamed as North America Community. Have you read where the NAC has been denied by these same trolls. Remember when the Texas Corridor was denied? Back when it was called the NAFTA Super Highway, the same trolls ridiculed anyone who posted anything about it.

If you guys want a reformation. Fine with me but put it up to a national vote. Why do I say a national vote? Because that way every person in America gets a say about what happens to their children's future not just the corporate elites and foreign billionaires who seem to have so much influence with our politicians.

They have already done that! One MAJOR departure from constitutional requirements is the introduction of fiat money in violation of a clearly stated rule saying ONLY gold or silver may be used as legal tender, yet we have a huge chorus on FR singing hymns to fiat money and telling us that we are better off with fiat money and all who say otherwise are fools or worse. Many of the problems people moan and groan about are the direct result of our worthless funny money yet we have this chorus of FREEPERS saying there is no viable option other than worthless fiat money.
If we are going to have worthless scrip we should at least have demanded that the constitution be amended to allow it, the failure to do so makes a mockery of the whole process.

I wish I had kept the reference which I have lost but some wise soul once said something in words something like this,”The only legitimate purpose of government is to protect the citizenry from the criminal but invariably the government usurps the function of the criminal and becomes a greater danger to the citizens than the criminal could ever hope to be”. The history of the world certainly bears this out, since formal government came into existence criminal governments have wreaked havoc on a level no non-governmental criminal element could ever have hoped to rival. Private criminal operations are sporadic, the perpetrators take time off to enjoy their ill gotten advantages, government criminals never stop, their attacks are relentless and endless.

Nicely worded.

I like to tell my pistol course students that a firearm can be a most effective etiquette lesson, in that possession of a firearm helps offenders remember the lessons in manners and good behavior which their parents tried to teach them but somehow failed.

I remember reading a review of the Fourth Turning many years ago when it first came out (1999 or so???). The authors had said how the generation coming of age (18-25?) or so in the year 2000 was the same generation that had brought about the “Roaring 20s” as I recall. Very much the go-getters, aggressive and productive lot. But, generally usually very selfish and self-serving. UNLESS some dramatic event took place that would unite them in a larger focus. Then they would be the strong leaders that would lead in common purpose.

This was before 9/11. I always think of the young men and women that joined up and have been fighting so heroically when I recall this review. The more I hear of it the more I think that I need to read it.

I'm not sure why they are still sitting on it. Some other freeper from a month-ago thread was saying how based on the verbal questioning it was apparent that all the justices had already come to their decision. (It seems that is the case most of the time?)

The freeper said now they are crafting a carefully worded statement so as not to give any rights - or take away rights, that they do not intend.

So - I guess their isn't a deadline. But - it was for this reason that Montana awhile ago had one of these resolutions saying if they DID ban certain weapons, etc. that Montana would do something (declare sovereignty, secede, ...) as one of the things that is in the negotiation for Montana becoming a state was that it would be able to determine the gun laws for the state. (Or something like that).

The reformation I have in mind is, to steal a marketing line from the U.S. Army,  "A Reformation of One"
 
It consists entirely of the individuals who make up the system - which is We the People - recognizing what the founders considered to be the legitimate function of government - which is "To secure these rights" - and to refuse to act in a manner that is not consistent with or within the scope of that purpose.
 
I can not see how a person thus self-constrained would participate in something like the formation of the NAU without a clear, informed, mandate from the citizenry.
 
Corruption begins with the individual and so, I believe, does integrity.
 
The conscience is mightier than the sword.

That is true however

Just for fun, can you guess which company with over 500 employees can boast the following statistics relating to its employees? The figures were compiled over three years ago, but turnover has since been slight.

29 have been accused of spousal abuse
7 have been arrested for fraud
117 have bankrupted at least two companies
19 have been convicted of writing bad checks
3 have been arrested for assault
71 cannot get a credit card due to bad credit
14 have been arrested on drug-related charges
8 have been arrested for shoplifting
21 are current defendants in lawsuits
84 are subject to fines and incarceration for drunk driving

If you guessed the United States Congress, you were a better player than I.

Year after year, our 535-member United States Congress passes laws to keep the rest of us in tow.

What was it you said about the conscience being mightier than the sword? Not amongst that crowd it isn’t. Please, don’t go off on a slant about how we need to pray for guidance in dealing with this situation. I know what needs to be done, unfortunately it is still against the law to hang thieves in this country.

True, but that is largely due to the apathy of the citizenry. 
 
We have abdicated our responsibility in favor of bread and a high-def, surround sound circus.
 
When our representatives become corrupt and stray from their purpose, WE should be relentless in shining the light of truth upon them and demanding justice.  It's pretty simple: they are not doing their job because WE are not doing ours. 
 
WE have been neglecting the eternal vigilance required for freedom.

I don’t know about you but myself, I am retired and I have plenty of time during the day to read on the Internet. I read both sides of the rant then make determinations for myself. When I was working 12 hours a day trying to support a family and run a business I wasn’t anywhere near as aware of the facts as I am today. This is in large part due to the lying national news media.

So, my conclusion is that this apathy you mention is due in large part to the deceit shown on the MSM evening news and socialist controlled newspaper system across the nation. If you don’t know about a problem it is awful difficult to fix it. I realize this is all by the design of both political parties. Consequently if they are injured during the course correction I will not be the one shedding tears.

Bread and Circuses - brought to us by, guess who, the collectivist sponsors of the MSM. 
 
The appetite of tyranny always feeds upon the tyranny of the appetite.
 
The collective feeds upon the appetite of the individual;  and BIG money is spent in finding new and creative ways of manufacturing those appetites.
 
Apathy seems to be a condition desired by our collectivist would-be bee keepers.   Apparently appathetic bees make better consumers; they never question what is being fed to them.
 
"Buy more, bee happy"  is a central thematic pilar in George Lucas' THX1138.
 
Many of us are beeginning to recognize that communism and corporatism are really just two forms of the same thing:  collectivism.  (Robert Heinlein illustrated both forms of collectivism in Starship Troopers.)
 
The collective's nature is to subjugate the individual for the benefit of the collective hive.
 
IMHO, the explicit intention of the writers of the Declaration of Independence was for the collective, the state, to serve the individual by preserving the individual's inalienable rights; and not for the individual to serve the collective, as is becoming the case now - and as has been the case in the cyclical past.
 
Fascism is classicaly defined as a governmental structure which becomes the object of mandatory worship and servitude.
 
This was precisely the reason the 1st amendment is first.  A wall was errected between the religion of secular humanism (aka Baal) and the institutional tool of government - which is the Republic; and the individual was empowered with freedom of speach in order that they may give warning and form a defense against the tyrannical instinct of the hive.

HJR 1089 Passed unanimously, then went to the Senate, it was read twice in the Senate and went back to Rules Committee where it died a quiet death now that this Session is closed.

I called Rep. Charles Key’s office and asked if the Bill will be reauthored again next session. His staff is researching the answer for me.

If any of you wish to do some more research, the correct name for this Bill is HJR 1089 -House Joint Resolution 1089

I heard that Georgia passed a similar Bill. It was written almost word for word as this one. I have not done any research on it.

Your anology of succession from the Union does not fit. The south formed a collective block of States and created it’s own federal government. In doing so, the Confederate government confiscation Union property en masse. A State has it’s own rights, including the right to stop supporting the federal government and vice-versa.
