Effectively the prisoners at Guantanamo now have more rights than the soldiers who are guarding them.

Yup. And just wait till the lawyers start to subpoena the troops or CIA operatives who captured them, and allege torture, etc., to make 'evidence' inadmissable, blah, blah, blah.

Not to mention the fact that many of the attorneys will pass messages back and forth between the captives and their terrorist pals.

Based on the Military Extraterritorial Jurisdiction Act, you are correct.

Go to this thread: http://www.freerepublic.com/focus/f-news/2030632/posts

Our troops are now FOREVER chargeable as civilians if some prosecutor doesn’t like any of their actions as soldiers.

Had John Kerry become president, he could have charged Petraeus for deaths on the battlefield of ENEMY combatants IF he simply disagreed with planning or decision-making.

It’s a terrible time to be a combat soldier.

A good time to be a terrorist, though. You get 4 squares, reading material, entertainment, your own personal lawyer, and now your own personal judge.

We are insane.
