I love Fred, but we wouldn’t want to name him to the SC. Too old, known illness, and no judicial experience would all be problematic. Fred’s probably even too long out of the senate to glide through confirmation because of that. I think Bush got the model right, after a little browbeating, with his two Justices.

You are right about Fred's age and illness as liabilities for SC because of the amount of time he would serve. Janice Rogers Brown would be the best of all IMO, but they would go after her like a ravenous wolf pack and her knowing that was why she asked President Bush not to consider her...

Fred was a good prosecutor but as you said not a judge. However, TECHNICALLY it's not really necessary for a SC justice to have any law experience. In practice it would be a tough sell for NO law experience.

I'd take Fred as a 5-15 year place holder any day though in preference to a crap nominee and McCain geniunely likes him.

I should have added that I too REALLY like Bush’s 2 successful appointments.
