That may happen. I don't know. All I DO know is this. Obama's picks will be awful. He didn't even support John Roberts, one of the most competent individuals to ever be on that court. Obama has also shown distain for the constitution despite known better as he taught con law. Hillary Clinton will appoint another Breyer or Ginsburg.
We MIGHT get a good pick from McCain. We WON'T get a good pick from Obama or Clinton. I voted for Ron Paul in the primary (based on domestic issues, not foreign policy where I'm about 1/2 way between McCain and Paul). He lost. The primary voters chose McCain. I've considered a protest vote, but for all of McCain's fault, he DID vote for Alito and Roberts, and Clarence Thomas.
I won't flame anyone who protest votes in this election unless it is for Obama or Hillary, but this time, I'll have to go with McCain, at least until two more judges are in our favor.
