I'd like to thank Sen. Scott Brown, R-Wrentham, for his leadership in addressing a serious issue in the aftermath of a terrible tragedy.
In early 2007, following the controversy of the Haleigh Poutre case, I contacted his office to ask that he file legislation to prevent those who had injured a person from serving as that person's health care proxy.
The Poutre case highlighted this important issue because the foster father of the girl was accused of inflicting the injuries that incapacitated her, and subsequently started legal action to be allowed to make health care decisions for her.
His interest was suspected to be in keeping Haleigh alive to avoid a murder charge, but in other circumstances an abuser might want to "finish the job" by having the health care facility withdraw treatments.
In short, it is axiomatic that health care professionals cannot trust that an abuser would consider his or her victim's interests or desires as paramount...........
