Richard Thompson, chief counsel of the Christian-based Thomas More Law Center of Ann Arbor, Mich., that is representing Chessani, said the pretrial rulings against Chessani and the prosecution itself "stink to high heaven." "Denying us the right to take Murtha's deposition so that we could show undue command influence, as well as denial of our request for production of documents in the possession of Lt. Col. Chessani's superiors, makes it impossible for us to render this loyal Marine officer the effective assistance of counsel he deserves," Thompson said in a written statement. "They are attempting to throw him under the bus."

Is due process being denied here, does that get questioned when Folsom's ruling is appealed?

We need to talk to Rooney to be sure, but I don’t believe this decision will be appealed. I believe they are preparing for a guilty verdict and an appeal of that decision by laying down markers now.

You are right about the fact that Murtha has exerted undue command influence to railroad these innocent marines and the fact that they are refusing to allow all the facts and excuse Murtha from trial investigation that would prove the defendents innocent is just plain evil. Another unjust case allowed to proceed so the fat cat Murtha can falsly charge an innocent man and men for fighting back in a firefight. The whole thing stinks.
