I heard on the news this morning on WMAL in Washington that Hillary has NOT ruled out putting her impeached husband on the ballot as her VP.
Is this legal?? The Constitution says candidates for VP MUST be eligible to be President. Bubba is not eligible since he has served his two terms.
I agree, which is why I noted that it would likely be considered non-justiciable. However, I simply don't think the issue is as cut-and-dried as you make it. I understand your argument, but I think your interpretation defeats the major purpose of the amendment, which was to prevent a "benevolent dictator" and to ensure that there would be no compromise to the separation of powers doctrine, not unlike there was during the FDR administration. By interpreting the language of the 22nd to allow for third term Presidents, it renders much of the point of the amendment useless. That seems like a bad result. We don't like bad results, and we tend to find ways to avoid them.
What's a great way to avoid this bad result? Find that the 22nd Amendment prohibits third term Presidents. Period. Everyone goes home happy.
In order for a court to rule as you suggest they would have to rule that the drafters of the 22nd really meant to say “No person shall be eligible to serve as President...” but somehow just couldn’t manage to find the right words.

I suspect DJ exaggerating or reporting something unconfirmed. And getting people to go off without checking.
Obviously not, but I am pretty sure that no one ever thought to write the amendment around such an outlandishly impossible situation. If any man had the political horsepower and charm to do as you suggest, he’s have the influence to see the 22nd repealed in six months time.
