Here's a great example of how not to act when the cops pull you over: http://www.youtube.com/watch?v=IMaMYL_shxc

This out of control, power drunk, sorry excuse for a representative of law enforcement should (and hopefully will) be in jail.
Regardless of the outcome of the traffic ticket, the only question left will be for how much money will the jurisdiction settle the lawsuit. The floor is probably set at $1 million. The guy can probably name his price.
This is NOT lawsuit abuse. This type lawsuit helps prevent this type thing from happening again so it serves a noble purpose.

This driver’s attitude from the beginning set the tone of the encounter. It’s sad that so many young brats grow up to be older brats these days with no respect for authority and who think they must challenge and give attitude to authorities.
In this case I’ll support the officer 100%. The jerk deserved to get tasered as it was obvious he had no respect for authority from the beginning. The officer shouldn’t even be expected to wrinkle his shirt in dealing with this jerk.

The cop should be charged with reckless endangerment.
What complete moron would taser someone along side of a very busy highway knowing that the victim may fall into the path of an oncoming vehicle?
Besides everything else, tasers kill.
This is clearly assault with a deadly weapon.

I would not have gotten tasered because I know when it’s appropriate to submit to appropriate authority.
This cop is has legitimate authority delegated to him by the State, which has been delegated authority by God and affirmed by our society.
The cop’s requests were neither unreasonable nor unlawful. Add to this his reasonable fear for his own safety, and he was well within his rights to do what he did.
I would not have gotten tasered, because I would have submitted to his reasonable requests.
Of course, the anarchists among us can argue against authority all you want. Your rebellion does not negate legitimate authority....

why would he be read his miranda rights? there was no basis for miranda here. this guy watches too much TV.
the cop tells the guy to stop and the guy walks away. more than that, the guys hands go towards his pockets which is bad.
i think the cop should have explained what was happening better. and even pulling the taser may have been premature. but these guys work alone and i won't second guess. i would assume that the officer's actions were proper by the letter of his depts procedures. he was not being complied with and this guy was moving in a furtive manner.

refusing to sign a speeding ticket or submit to being arrestedThis is really confusing. Was he refusing to sign a ticket or resisting arrest?

In the event that a motorist refuses to sign, a trooper can simply write "refuses to sign" on the citation, which is then given to the driver, or they can chose to arrest the motorist, Roden said. End of problem.

"
Was a Utah Highway Patrol trooper acting within policy when he used a Taser on a driver who refused to sign a traffic ticket?"
If he was, why did he have to lie? or is that too "within policy"?

In my opinion, Trooper John Gardner needlessly escalated the incident. Some people do not have the demeanor to be police officers, I think that includes Trooper Gardner.

What I would like to know is how recently this big gun, little d*ck LEO got his training and his shiny new Tazer. It was probably burning a hole in his holster I’ll bet that this pin head was all hopped up on Krispy Kremes and couldn’t wait for a chance to use it. I mean, what’s he gonna talk about with the cute new girl in dispatch???
