Colorado Supreme Court Gives Green Light to Restore Personhood to the Unborn

DENVER, Colorado, November 13 /Christian Newswire/ -- After weeks of review, the Colorado Supreme Court has just released a decision granting Colorado for Equal Rights permission to move forward with a ballot initiative to restore personhood to human beings from the moment of conception.

Presidential candidate Dr. Alan Keyes, along with American Life League Founder Judie Brown, will speak about the necessity of such an initiative.

Colorado for Equal Rights will now begin gathering the 76,000 signatures required to put this issue on the November Ballot. This Constitutional Amendment will redefine the term "Person" in three parts of the Colorado Constitution to mean from the moment of fertilization.

Despite two unanimous votes from the Title Board, the petition was appealed based on claims that it dealt with more than one issue. The Colorado Supreme Court ruled that the petition was, indeed, a single-subject issue and affirmed previous rulings by the Title Board.

"We fully expected this positive decision from the Colorado Supreme Court. We are pleased that they supported the Title Board's previous decisions. Plans to begin our petition drive are underway," stated Kristi Burton, spokesperson of Colorado for Equal Rights.

A press conference will be held today, Tuesday, November 13, 2007, at 3:45pm in the Pine Room of the Timbers Hotel at 4411 Peoria St. in Denver, Colorado, to discuss the ruling.

Is there any real possibility of this passing? Colorado seems a very unlikely venue.

It doesn't propose an outright abortion ban. But it does affirm the personhood of the unborn. That's a debate the Left wants to avoid. It would rather frame it as "choice.

Colorado seems a very unlikely venue.

There are lots of lefty resort towns in Colorado, but the state is also the home of the Air Force Academy and the Focus on the Family headquarters. So it's a toss-up as to whether it could pass a referendum.

CO - lots of Evangelicals, lots of Mormons, several large Catholic communities. It has a chance. I would love to see the abortion debate shifted to the 14th Amendment - “nor shall any State deprive any person of life, liberty, or property, without due process of law”

I’m not from CO ,,, My question is why would the state supreme court get involved in the ballot initiative process in the first place ? I can see where they would have a role after a change was enacted in deciding affected statutes and such ... but why do the citizens have to get past them beforehand..

Not trying to pick a fight, but an originalist would say this initiative would not *necessarily* bring that into play. According to that legal philosophy, whatever the framers of that amendment meant by "person" is binding in its interpretation. And if they had a specific conception of personhood that did not include the unborn, this initiative wouldn't prevent abortion on 14th Amendment grounds.

On the other hand, they might have had a more "living" interpretation of personhood, leaving it to the people of each time to decide. I doubt that though.

My point is that, even if the initiaitive passes, it's not a slam dunk even by conservative legal philosophies.

Once there were “CO - lots of Evangelicals, lots of Mormons, several large Catholic communities. Now - lots of Californians - probably not happening. The Supremes did not endorse the idea they only said the petition was technically correct. When the citizens last tried to stop special rights for homosexuals, they lost in court. They were represented by once AG Salazar, Now Democratic Senator Salazar.
