If the child has the mental capacity of a three year old, then he should have never been placed in a learning environment with children with the mental capacity of six year olds. It's not fair to him, it's not fair for the teachers, and it's certainly not fair to the other students.
Having said that, I agree that processing this incident as a "criminal matter" is an awful condemnation of our society.

If the child had the social skills of a 3 year old, but far advanced cognitive abilities then he can be in the class with supports.
A great deal of autistic children are brilliant yet are significantly delayed socially, or have serious sensory issues which preclude them from doing full inclusion.
