He had to have driven the car to that location, uh....DRUNK.
And where's your proof of that?
He could have easily walked there. He could have sat in the vehicle and consumed alcohol (different offense no doubt, but not DUI). He could have gone to a party and a friend dropped him at his vehicle.
If it can be proven that he drove there drunk, then I change my stance. But I see no proof.
But nobody saw him do it.

In my youth, I have driven out to meet friends with no intention of getting intoxicated, ended up intoxicated anyway and sleeping it off in the car rather than driving drunk.
This ruling seems rather unfair.
What if “that location” was the parking lot of the bar where he had been consuming adult beverages?

A lunatic walked around a restaurant counter to attack me. The cop working as a janitor saw only that. He could not do a thing to the guy until the nutcase had his hands on my throat. Only then could he do something about it.
He was in a parking lot. He might have been sober when he parked it there. If he would have not had his keys in the ignition he would not be guilty.
