AN excellent article! I had a wonderful prof during my undergrad years and his opinion of secession was that it was illegal because the Constitution had been debated and accepted by all the states and could only be changed by ALL the states IN AGREEMENT. This certainly clarifies what he was saying. This piece will certainly be valuable for me in the close future. I have to do an in-depth class in state history here as part of my grad program- and this was one of the states that seceeded!

also, how do you "explain away" the TENTH AMENDMENT to the BOR, which states that those powers NOT CEDED to the federal government REMAIN the powers/RIGHTS of the STATES/PEOPLE???
i will assume, in the absence of PROOF to the contrary, that you agree that secession remains a viable/lawful OPTION in the face of federal TYRANNY.

You are welcome. What I posted was just one reply by Mr. Sandefur in an ongoing blog battle between him and other libertarians but mostly Mr. Sobran over the rightness of secession. Both are credentialed libertarians. Being a libertarian, Mr. Sanderfur caught a lot of flack from other libertarians for taking what appeared to be an anti-libertarian point of view.
